Pelindungan Hukum Atas Hak Cipta Terhadap Penyelenggaraan Situs Layanan Streaming Film Dan Serial Televisi Yang Ilegal Di Indonesia (Studi Kasus Situs Idlix)

Abstract

The use of the internet makes it easier to access films, but has negative impacts such as piracy which is detrimental to the film industry. Illegal sites such as Idlix allow people to watch and download films without permission, violating Copyright Law No. 28 of 2014 and harming the creative economy. Therefore, this thesis is entitled "Legal Protection of Copyright Against the Implementation of Illegal Film and Television Series Streaming Service Sites in Indonesia (Case Study of the Idlix Site)". The formulation of the problem in this thesis is: how do copyright holders deal with the implementation of illegal film and television series streaming service sites in Indonesia, What are the legal consequences of copyright infringement against the implementation of illegal film and television series streaming service sites in Indonesia, and How is copyright infringement of the implementation of illegal film and television series streaming service sites in Indonesia. The method used in writing this thesis is the normative juridical research method, namely a method that refers to legal norms carried out by means of literature studies in order to obtain secondary data in the form of primary, secondary, and tertiary legal materials related to the problems studied, this research is descriptive in nature. The results obtained from this legal research indicate that Copyright regulations in Indonesia are regulated in Law Number 28 of 2014 concerning Copyright, copyright holders have exclusive rights to use and manage their creations, both in terms of moral rights and economic rights. In Indonesia, the provision of illegal film and television series streaming service sites is a serious violation of copyright. Copyright infringement results in creators and/or copyright holders not getting their rights as they should, both exclusive rights and economic rights. Copyright infringement in the provision of illegal streaming service sites in Indonesia occurs when a party distributes, broadcasts, or reproduces copyrighted works in the form of films and television series without permission from the copyright owner in violation of Law Number 28 of 2014 concerning Copyright, which protects the moral rights and economic rights of creators or copyright holders over their works. The case of copyright infringement committed by the illegal streaming service site Idlix began in 2019 when the Defendant received access to the Idlix site platform through Mr. Aldi Pratama who is domiciled in Malaysia. One of the films uploaded to the Idlix site is "Imperfect: Karir, Cinta & Timbangan", a film produced by Starvision Plus. This film was downloaded by the Defendant from a free film sharing site and then uploaded to the Idlix platform to be watched for free by site visitors.
