Abstract

Autonomic principle which is used by the Regional Government is the one which is broadly given to regional governments to organize and take care of all governmental affairs stipulated in Law No. 23/2014 on Regional Government; one of them is the establishment of regional regulation. Regional regulation is the manifestation of regional autonomy in which in the process of the establishment of regional regulation, there will be the participation of the drafters of legal provisions as it is stipulated in laws and regulations. The research used judicial normative approach. Library research and documentary study were used as the primary data, while interviews were used as supporting and supplementary data. The gathered data were analyzed descriptively. The objective of the research was to find out the involvement of designing legal provisions in establishing regional regulations. The drafters of legal provisions are functional personnel which have task and function in drafting legal instruments. Legal provisions state that the drafters of legal provisions have to participate in establishing legal instruments, especially Regional Regulations. So far, the drafters of legal provisions have been form the Law and Human Rights Agency of North Sumatera. By the issuance of the Government Regulation No. 59/2015 on Participation of Drafters of Legal Provisions in Establishing Regional Regulations and their officers-in-charge obliges regional governments to have drafters of legal provisions. This includes the process of establishing legal product in the regions in which the drafters of legal provisions have task and function in guarding the establishment of good Regional Regulations. The existence of the participation of drafters of legal provisions in establishing Regional Regulations, it is recommended that the relationship between the Law and Human Rights Agency of North Sumatera and Regional Government of North Sumatera be increase so that their collaboration in establishing regional legal product can be synergic and good Regional Regulations according to legal provisions can be realized.
