Legal Aid, also known as legal aid, is a service providing legal advice to people who are unable to obtain legal representation and access in court both non-litigation and/or litigation fairly, therefore for every legal action brought against the accused needs to pay attention to his rights to truth and justice in accordance with the legal action carried out without discrimination in accordance with the protection of human rights.5 To prove the suspect's right or wrong, the suspects have the right receive legal assistance at every level of examination. To guarantee Fulfillment of the right to obtain State legal assistance requires all an official authorized to appoint free legal counsel for suspect if he is unable to provide legal counsel.6 this research using normative legal research, namely research that examines principles or legal principles.7 The approach in this research is a statutory approach, case approach, and analytical approach. The data source used is data primary, secondary and tertiary. The data analytical method used is data analysis qualitative, as a result of data collection through primary, secondary and tertiary data. From primary, secondary and tertiary data analysis is carried out to draw conclusions, which is related to theories, existing concepts with formulation problem. The conclusion in this study shows that in giving legal assistance for defendants or suspects who are unable to protect themselves rights have been quite effective in protecting a human rights perspective.
