Perlindungan Hukum terhadap Korban Penyalahgunaan Artificial Intelligence Berupa Deepfake Porn dalam Perspektif Viktimologi

Abstract

The advancement of digital technology, particularly Artificial Intelligence (AI), has not only brought positive impacts but also given rise to new forms of crime, such as the misuse of deepfake technology for pornographic purposes. This crime undermines the integrity and dignity of victims, especially women and causes serious psychological and social consequences. Although several legal instruments exist, such as the Electronic Information and Transactions Law, the Pornography Law, the Personal Data Protection Law, and the Law on Sexual Violence Crimes, there are still no specific regulations that explicitly address deepfake pornography. As a result, legal protection for victims remains suboptimal. This study aims to analyze the legal framework concerning the misuse of deepfake pornography technology in Indonesia, examine the forms of legal protection available to victims, and explore the legal policies that need to be developed through a victimological perspective. This research uses a normative legal method with a descriptive approach and qualitative data analysis. The data used are secondary data, obtained through literature review techniques from books, journals, online sources, and relevant legislation. The findings indicate that the current legal protections fail to deliver adequate justice and recovery for victims. In addition to weak law enforcement, the absence of an organized support system forces victims to face the impact of these crimes alone. In this context, the involvement of society and relevant institutions in providing support is also crucial. Therefore, legal policy reform is needed, focusing on victim recovery and rehabilitation, including effective content removal mechanisms, identity protection, and public education on the dangers of deepfake. A victimological approach is essential to ensure that victims are recognized as subjects with rights to comprehensive protection and recovery, with particular attention to the psychological and social aspects they experience after being victimized.
