Peranan Panitia Pengawas Pemilu Kota Medan pada Pemilihan Umum Kepala Daerah dan Wakil Kepala Daerah Provinsi Sumatera Utara Tahun 2013

Abstract

The supervisory of elections is an important part in the holding of the regional head elections, because the regional head election became honest, fair and democratic depends greatly on the extent to which the supervisory of elections work well and ensures the regional head elections take place in a democratic. The title of thesis was “THE ROLE OF THE SUPERVISORY COMITTEE OF ELECTIONS OF MEDAN IN THE ELECTIONS OF THE GOVERNOR AND VICE GOVERNOR OF NORTH SUMATERA IN 2013. This research was a descriptive study with a qualitative approach. The research was conducted in the City of Medan with analysis unit was The Supervisory Comittee of Elections of Medan. Choice of the location and the analysis unit based on the considerations that Medan is the biggest city in North Sumatera Province with the high level complexity, high populations and the number of voters at most in North Sumatera Province, so the elections problems are also big and very complex and beside that, also due to internal conflict among the commissioners of the Election Supervisory Committee of Medan at the time of the regional head elections.The result of research :(1)The Supervisory Committee of Elections of Medan has run its role as overseer of the regional head elections in accordance to the legislation. Based on the authority given by the legislation, The Supervisory Committee of Elections of Medan has been running the role pretty well, but the result of the research indicated the role of The Supervisory Committee of Elections of Medan played has not been fullest at the stage of updating the voters data and the voters list, and handling violations criminal acts of election (2). Based on the results of the research can be known that become barriers to The Supervisory Committee of Elections of Medan in carrying it’s supervisory task of organizing in The Elections of The Governor and Vice Governor of North Sumatera in 2013 is the existence of an ad hoc nature inherent in The Supervisory Committee of Elections of Medan; Human Resources problems; lack of facilities and lack of funds in The Supervisory Committee of Elections of Medan; internal conflict in The Supervisory Committee of Elections of Medan; the lack of socialization can be done by The Supervisory Committee of Elections of Medan; the lack of community participation in helping of the regional head election supervision; weak cooperation between institutions;too many laws and regulations that are not obvious and not firm.

Pengawas Pemilu merupakan bagian penting dalam penyelenggaraan Pemilu Kada, karena Pemilu Kada yang jujur, adil, dan demokratis sangat tergantung pada sejauh mana Pengawas Pemilu bekerja dengan baik dan menjamin Pemilu Kada berlangsung secara demokratis. Tesis ini berjudul ” PERANAN PANITIA PENGAWAS PEMILUKOTA MEDAN PADA PEMILIHAN UMUM KEPALA DAERAH DAN WAKILKEPALA DAERAH PROVINSI SUMATERA UTARA TAHUN 2013”. Penelitian ini adalah penelitian deskriptif dengan pendekatan kualitatif. Penelitian dilakukan di Kota Madya Medan dengan unit analisis adalah Panita Pengawas Pemilu (Panwaslu) Kota Medan. Pemilihan lokasi dan unit analisis didasarkan atas pertimbangan Kota Medan merupakan kota terbesar di Provinsi Sumatera Utara dengan tingkat kompleksitas yang tinggi, jumlah penduduk yang banyak dan jumlah pemilih yang paling banyak di Provinsi Sumatera Utara, sehingga permasalahan pemilu juga sangat kompleks dan banyak, disamping itu juga disebabkan adanya konflik internal di antara komisioner Panwaslu Kota Medan pada waktu Pemilu Kada tersebut. Hasil Penelitian sebagai berikut : (1). Panitia Pengawas Pemilu Kota Medan telah menjalankan perannya sebagai pengawas Pemilu Kada sesuai dengan yang diamanatkan oleh undang-undang. Berdasarkan wewenang yang diberikan undang-undang Panwaslu Kota Medan sudah menjalankan perannya dengan cukup baik, namun hasil penelitian menunjukkan peran pengawasan yang dilakukan Panwaslu Kota Medan belum maksimal pada tahapan Pemutakhiran Data Pemilih Berdasarkan Data Kependudukan dan Penetapan Daftar Pemilih Sementara dan Daftar Pemilih Tetap, dan pada penanganan pelanggaran tindak pidana pemilu. (2). Dari hasil penelitian dapat diketahui yang menjadi hambatan bagi Panwaslu Kota Medan dalam menjalankan tugas pengawasan penyelenggaraan pemilu pada Pemilu Kada Provinsi Sumatera Utara Tahun 2013 adalah adanya sifat ad hoc yang melekat pada Panwaslu Kabupaten/Kota; masalah sumber daya manusia; kurangnya fasilitas dan minimnya dana pada panwaslu kota Medan; konflik internal di dalam tubuh Panwaslu kota Medan; kurangnya sosialisasi yang bisa dilakukan Panwaslu Kota Medan; kurangnya partisipasi masyarakat dalam membantu pengawasan Pemilu Kada; lemahnya kerjasama antar lembaga; banyaknya peraturan dan perundang-undangan yang tidak jelas dan tidak tegas.
