Konflik Agraria (Studi Kasus: Konflik Pertanahan Antara Perusahaan Toba Pulp Lestari dengan Masyarakat Desa Pandumaan-Sipituhuta dalam Pembatasan Lahan Hutan Adat di Kecamatan Pollung, Humbahas)

Abstract

This research aimed find out the process of conflict resolution on the agrarian land restrictions incense residents that occurred in the Village District of PollungPandumaan-SipituhutaHasundutanHumbang District and the various community activities carried out during the process of resolving land conflicts. Therefore, this paper conducted to see how the role of the second element is Pandumaan-Sipituhuta villagers and PT. Toba Pulp Lestari in settlement efforts and maintain traditional land clearing and planting of eucalyptus trees. The method used is descriptive qualitative method of analysis is the discovery of the facts to problem solving. Collecting data in this study relied on the analysis of the data obtained in the field and interviews. The data becomes a discussion is primary data which is the main data of the results of field observations also with interviews, and secondary data obtained through the internet, papers and newspapers. The results of the study are presented in a systematic and evidence from the field that is processed, analyzed and described in a manner that contains descriptive with the process of resolving conflict over land in the village of Pandumaan- Sipituhuta with PT TPL, the conflicts that occur during the four (4) years since 2009. There are some results that conflict resolution, measurement of customary land with forest boundary planting eucalyptus trees, cooperation or partnership program between PT. TPL with Pandumaan-Sipituhuta Village Community and the policy of the Constitutional Court dated May 16, 2013 No.35/PUU-X/2012 of indigenous forest returns to the village community formed to draft law protecting the rights of indigenous peoples in the District HumbangHasundutan.
