Konflik Tanah Warisan pada Keluarga Batak Toba (Studi Kasus: Kecamatan Ajibata Kabupaten Samosir)

Abstract

Soil is a source of well-being for humans that contains a wide variety of natural resources that can be utilized humans are defined as economic value ( the value of religio - magical land) and social value.Land relations with humans to make changes in the arrangement of ownership and land tenure that gives effect to the pattern of the relationship between humans themselves.Social functions with the concept of land means that the land as the land of human life which is basically always a social life which serve to provide social activities of man as an effort in the development of the implementation of the land in order to run properly . The community has a different view in assuming ownership rights over land, causing uneven. The problem in this research are being formulated as follows: How the struggle Ajibata inherited land in the district of Toba Samosir ? How does conflict resolution in the family inherited land Batak Toba?The method used in this research is a case study with a qualitative approach , where the number of informants who have inherited land seizure cases as much as 10 informants . The results of this study indicate that the cause of the conflict over land inheritance on Toba Batak society is because of injustice in the distribution of the estate in a family , do not have a male offspring, so that the estate that has been shared , requested back by a brother who still has a relationship blood. the difference in views about the boundaries of the estate . The causes of conflicts over inheritance of land, essentially due to the absence of authentic proof /certificate of land ownership. Moreover, this conflict was triggered because the parents do not explicitly share the estate during his lifetime, process for resolving conflicts over land inheritance conducted in Toba Batak society is inseparable from the interference of the government and other parties
