Perekrutan Tentara Anak dalam Situasi Konflik Bersenjata Menurut Hukum Internasional (Studi Konflik Bersenjata di Republik Demokratik Kongo)

Abstract

Anak adalah bagian dari generasi muda yang memiliki peran strategis sehingga memerlukan pembinaan dan perlindungan terhadap hak-haknya dalam rangka menjamin pertumbuhan dan perkembangan fisik, mental, sosial secara utuh, serasi, selaras dan seimbang. Permasalahan yang akan dibahas adalah mengenai salah satu pelanggaran hak anak dalam kasus perekrutan anak sebagai tentara dalam konflik bersenjata atau peperangan yang dilakukan oleh kelompok bersenjata di Republik Demokratik Kongo. Metode penelitian yang digunakan adalah metode pendekatan yuridis normatif menggunakan bahan kepustakaan penelitian. Tahapan penelitian menggunakan penelitian kepustakaan: bahan hukum primer, bahan hukum sekunder, bahan hukum tersier untuk melengkapi data sekunder yang diperoleh melalui kepustakaan. Teknik pengumpulan data menggunakan data kepustakaan yang menganalisa secara sistematis buku-buku, konvensi-konvensi dan bahan-bahan lain. Perekrutan anak dibawah umur untuk dijadikan sebagai tentara dalam konflik bersenjata merupakan pelanggaran terhadap aturan-aturan yang telah dibuat oleh Hukum Internasional. Berkaitan dengan perekrutan tentara anak dalam konflik sipil bersenjata, Republik Demokratik Kongo sendiri telah melanggar beberapa aturan dalam Konvensi Jenewa IV 1949, Protokol Tambahan I tahun 1977, Protokol Tambahan II tahun 1977, Konvensi Hak Anak, serta Protokol Tambahan tahun 2000 yaitu melakukan perekrutan tentara anak, tidak memberikan perlindungan terhadap anak yang direkrut sebagai tentara dalam konflik bersenjata, serta tidak membantu pemulihan fisik dan psikologis tentara anak pasca perekrutan serta penyatuan kembali kehidupan sosial anak-anak yang telah direkrut dan terlibat dalam permusuhan.

Children are part of the young generation who have a strategic role that requires the coaching and protection of their rights in order to ensure the growth and development of their physical, mental, and social as a whole, harmonious, and balanced. The issue to be discussed is one of the violations of the rights of the child in the cases of child recruitment as soldiers in armed conflict or warfare which committed by armed groups in the Democratic Republic of Congo. The research method used is normative juridical approach using literature materials research. The research stages used literature research is: primary law materials, secondary law materials, tertiary law materials to complete the secondary data that obtained through the literature. Data collection techniques use bibliographic data which systematically analyze books, conventions and other materials. The recruitment of under age children to serve as soldiers in armed conflict is a violation of the rules established by International Law. Related to the recruitment of child soldiers in armed civil conflicts, the Democratic Republic of Congo itself has violated some of the rules of Geneva Convention IV 1949, Additional Protocol I of 1977, Additional Protocol II of 1977, Convention on the Rights of the Child, and Additional Protocols of recruiting child soldiers 2000 ,where they does not provide protection against children recruited as soldiers in armed conflict, and does not assist the physical and psychological recovery of post-recruitment child soldiers and reintegration of the social life of children who have been recruited and engaged in hostilities.
