Analisis Yuridis Pengumuman Bidang Tanah dalam Memberikan Kesempatan Kepada Pihak yang Berkepentingan Mengajukan Sanggahan Atas Pendaftaran Tanah Sporadik (Studi Kasus Putusan Mahkamah Agung Nomor 77 PK/TUN/2015)

Abstract

Reality encountered the fact that there are still land disputes due to legal certainty that has not been achieved for the purpose of land registration. The occurrence of cancellation of certificates of land rights based on the Supreme Court Ruling Number 77 PK/TUN/2015 stated that the issuance of the disputed object did not comply with the procedures stipulated by the laws and regulations, namely not making an announcement of land plots, hence, the Plaintiff lost interest in filing a lawsuit against the disputed object. As the announcement is regulated in article 26 of PP No. 24 of 1997 concerning Land Registration. The problem formulation in this research is what is the process of announcing land plots in land registration for the first time, how is the application of announcement of land plots in sporadic land registration (a case study of Supreme Court Ruling No. 77 PK/TUN/2015). and what is the legal protection for parties who are disadvantaged over sporadic land registration do not apply the process of announcing land plots (a case study of Supreme Court Ruling No. 77 PK/TUN/2015).

This is a normative juridical research type which is descriptive analysis in nature. The source of the data in the research is secondary data, namely primary. secondary and tertiary legal materials. The collection technique is obtained from library research (Library Research). The data are analysed with qualitative methods then the conclusions are drawn using deductive thinking methods. The research results conclude that process of announcing land plots in land

registration for the first time is by carrying out out at the stage of proving rights and bookkeeping after the stage of collecting and processing physical data. Application of announcement of land plots in sporadic land registration (a case study of Supreme Court Ruling Number 77 PK/TUN/2015) that by not carrying out the process of announcing land plots on the object of the dispute eliminates the opportunity for interested parties to provide objections to the registration of land rights. Legal protection for parties who are aggrieved over sporadic land registration does not apply the process of announcing land plots (a case study of Supreme Court Ruling Number 77 PK/TUN/2015) that the issuance of the disputed object does not comply with the procedures determined by applicable regulations and violates general principles of governance based on this matter the judge ordered the Defendant to cancel SHM (Certificate of Ownership) Number 327, Village/Kelurahan Sukaraja on behalf of Intervening Defendant II. Suggestion: The announcement process should be able to minimize legal problems over the ownership of a land object that is registered at the Land Office. The Medan City Agrarian Office should carry out the process of announcing land plots as this process has been regulated in PP No. 24 of 1997. For parties with an interest/objection to land objects whose land rights have been issued, as in the example of this research case, to get legal protection by submit a lawsuit to the State Administrative Court where the land object is located so that a court ruling

becomes the basis for getting the rights back.
